2. Website purpose and no professional advice
Content on this website (including articles, tools, calculators, templates and downloads) is provided for general information only. It is not accounting, tax, legal or other professional advice and does not create a client–practitioner relationship.
You should obtain advice specific to your circumstances before acting. Results from interactive tools (including tax estimates and document generators) are illustrative and may not reflect your full legal or tax position.
Website disclaimers displayed on individual pages form part of these Terms.
3. Use of the website
You agree to use the site lawfully and not to:
- Attempt to gain unauthorised access to systems, data or other users’ information;
- Interfere with or disrupt the site, security measures or related services;
- Submit false, misleading or abusive content via forms or tools;
- Scrape, harvest or bulk-extract content or personal data except as allowed by law or with our written consent;
- Use the site to transmit malware or engage in fraud or spam.
We may suspend or restrict access if we reasonably believe these Terms have been breached.
4. Enquiries, forms and leads
When you submit a contact, service enquiry, tool or download form, you confirm that the information you provide is accurate and that you are authorised to provide it. We will process personal information as described in our Privacy Policy.
Submitting a form does not oblige us to accept you as a client. Any engagement for professional services will be on separate terms agreed in writing (or as otherwise confirmed by us).
5. Online tools and downloads
Interactive tools and resources are provided “as is”. You remain responsible for checking outputs (including share certificates, reports and estimates) before use and for compliance with company, tax and other law. We may change, suspend or withdraw tools without notice.
Lead magnets and generated files may be delivered by email or signed download links. Links may expire; keep your own copies where needed.
6. Intellectual property
Unless otherwise stated, we or our licensors own the intellectual property in the website design, branding, text, graphics and software. You may view and print materials for your personal or internal business reference. You may not copy, republish, sell or commercially exploit site content without our prior written consent, except for fair dealing permitted by law.
Trade marks of The Tax Shop network remain the property of their respective owners.

The site may link to third-party websites or products (including franchise head-office materials and external software such as Anchor). We are not responsible for third-party content, availability or privacy practices.
8. Cookies and similar technologies
We use cookies and similar technologies required for the site to function (for example session, security and language preference). Where analytics or optional cookies are enabled, they will be described in our Privacy Policy or cookie notice. You can control cookies through your browser settings; disabling some cookies may affect site functionality.
9. Disclaimer of warranties
To the fullest extent permitted by South African law, the website and its content and tools are provided without warranties of any kind, whether express or implied, including fitness for a particular purpose or uninterrupted availability. We do not warrant that the site will be error-free or free of harmful components.
10. Limitation of liability
To the fullest extent permitted by law, TSRK and its members, employees and agents will not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, data, goodwill or business opportunity, arising from your use of (or inability to use) the website, tools or downloads.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded under South African law (including mandatory consumer protections where they apply).
Where liability cannot be excluded, our total aggregate liability arising from website use is limited to R1 000 (one thousand rand) or the minimum amount required by law, whichever is higher.
11. Indemnity
You agree to indemnify and hold us harmless against claims, losses and expenses (including reasonable legal fees) arising from your misuse of the site, your breach of these Terms, or your reliance on general website content as if it were professional advice, except to the extent caused by our gross negligence or wilful misconduct.
12. Privacy
Our processing of personal information is described in our Privacy Policy, which forms part of how we operate this website. Our POPIA & PAIA Manual provides further statutory information.
13. Changes to the site and Terms
We may update the website and these Terms from time to time. The “Last updated” date will change when we do. Continued use after changes constitutes acceptance of the updated Terms, except where mandatory law requires a different process.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Subject to any mandatory rights you may have, the courts of South Africa (and in particular those with jurisdiction in the Western Cape, where our practice is based) will have jurisdiction over disputes arising from these Terms or the website.
We encourage you to contact us first so we can try to resolve concerns informally.
15. General
- If any provision of these Terms is unenforceable, the remainder stays in effect.

- These Terms are the entire agreement between you and us regarding website use, and do not replace any separate client engagement letter or service agreement.
